The Taxpayer Advocate Service states the conditions plainly: to use the online application, &#8220;Your principal business, office, or legal residence is in the U.S. or a U.S. Territory; and the responsible party&#8230; must have a valid Social Security number, Individual Taxpayer Identification number (ITIN), or EIN.&#8221; A founder who runs the business from abroad fails the first condition. That is why the same page closes the point with a single sentence: &#8220;International applicants can get an EIN by phone, mail, or fax, but not online.&#8221;<\/p> <p>There is a second gate inside the application: the responsible party. The IRS requires the person &#8220;in charge of the entity and its assets&#8221; to be named with a Social Security number, an ITIN, or an EIN, plus a signature. For a solo non-resident founder, that responsible party is you, and if you do not yet have an ITIN, the only lanes open to you are the ones you can use from abroad.<\/p> <h2><span class=\"ez-toc-section\" id=\"The_EIN_wait_time_depends_on_which_lane_you_can_use\"><\/span>The EIN wait time depends on which lane you can use<span class=\"ez-toc-section-end\"><\/span><\/h2> <p>The wait is set by the lane, not by how good your documents are. The IRS writes that faxing the SS-4 returns the EIN &#8220;in about 4 business days&#8221; and that a mailed application returns &#8220;in approximately 4 weeks&#8221;. It also warns that &#8220;High inventory levels may result in processing delays&#8221;, the caveat that has caught founders during filing-season backlogs.<\/p> <p>For international applicants the routing differs from the domestic one. Fax the SS-4 to 304-707-9471 (or 855-215-1627 from within the US), and mail it to the EIN International Operation in Cincinnati. The domestic US fax number is 855-641-6935. The phone lane is 267-941-1099, Monday to Friday from 6 a.m. to 11 p.m. Eastern time, and it is not toll-free.<\/p> <h2><span class=\"ez-toc-section\" id=\"The_two-week_catch_after_the_number_lands\"><\/span>The two-week catch after the number lands<span class=\"ez-toc-section-end\"><\/span><\/h2> <p>The EIN unlocks the bank account immediately: &#8220;You can use your EIN immediately for most business needs. For example, when you: Open a bank account.&#8221; But the IRS publishes a second, quieter wait on the same page: &#8220;Wait up to 2 weeks to: Pass an IRS Taxpayer ID Number (TIN) Matching Program, E-file a tax return, Make tax deposits and pay electronically.&#8221; A brand-new EIN can take up to two weeks to validate in the TIN Matching Program, the system payers use to verify a tax ID against IRS records. So even after the number arrives, a TIN match can add a short second lag, and that lag tends to get blamed on the bank when it is the IRS again.<\/p> <h2><span class=\"ez-toc-section\" id=\"How_to_shorten_the_EIN_wait_time_as_a_non-resident\"><\/span>How to shorten the EIN wait time as a non-resident<span class=\"ez-toc-section-end\"><\/span><\/h2> <p>The wait is mostly a function of the lane you pick, and a few choices move you to a faster one:<\/p> <ul class=\"bs-checklist\"> <li><span class=\"bs-checklist-box\">\u2713<\/span><p><strong>Form the entity first, and use the exact legal name.<\/strong> The IRS says to register with your state before applying, and its systems accept only letters, numbers, hyphens and ampersands in the business name: enter it exactly as it appears on your formation documents.<\/p><\/li> <li><span class=\"bs-checklist-box\">\u2713<\/span><p><strong>Fill out Form SS-4 before you call.<\/strong> The phone lane issues the EIN during the call, but the assistor works from the SS-4, so a completed form means you answer instead of stalling.<\/p><\/li> <li><span class=\"bs-checklist-box\">\u2713<\/span><p><strong>Use the phone lane if you are international.<\/strong> 267-941-1099 runs Monday to Friday from 6 a.m. to 11 p.m. Eastern time and is the only immediate route for a founder without a US principal place of business. Budget for the time zone and the one-EIN-per-responsible-party-per-day limit.<\/p><\/li> <li><span class=\"bs-checklist-box\">\u2713<\/span><p><strong>If you fax, provide a return fax number.<\/strong> The IRS sends the EIN back by fax in about 4 business days only when you give it a number to reply to; without one you fall back to the mail timeline.<\/p><\/li> <\/ul> <p>Two habits drag the process out for no reason. The first is requesting a new EIN when the entity does not need one: the IRS requires a new EIN only on an ownership or structure change, and you do not need one just to change your business name, address or responsible party.
